In the event of a dispute, the German version of our conditions of auctions is legally binding. This English version of the auction terms and conditions is for general guidance only. If parts of these conditions of auctions are not applicable, all others still apply. The conditions also apply for all business that has been done with items beyond the auction, in particular, the after-sale. Place of fulfilment and jurisdiction for both parties is Basel.ġ0. HIWEPA AG is authorized to exercise all the rights of the consigner from his instruction and from the acceptance of the bid and at his expense.ĩ. No complaints are admissible with lots.Ĩ. The quality and the condition of the objects have to be verified by the buyer during the exhibition. No complaints against the auctioneer is accepted after acceptance of the bid. Complaints are inadmissible if modifications of any kind have been made to the relevant item. Legitimate complaints must be reported not later than three days after reception of the item. Wear and tear or minor damages are not necessarily included in the catalogue descriptions. Catalogue descriptions are provided to the best knowledge and belief but do not represent assured characteristics and can not be the basis for any complaints or demands of any kind. Term of payment is 14 days, unless stated differently in a written credit agreement.ħ. Additionally, the buyer will be charged possible shipping- and credit card- resp. VAT is included and not deductible in any case. The buyer shall pay a buyer's commission of 19% of the hammer price. HIWEPA AG has done all the necessary with the handing over of the items to the post office.Ħ. Shipping of the purchase items is at the expense and risk of the purchaser. In case the purchased item is delivered to the buyer before full payment, its ownership remains with HIWEPA AG until full payment. The auctioned item will be delivered to the buyer after full payment of the invoice only. With the acceptance of the bid, all risks of the state and condition of the items will go over to the purchaser, in particular the case of accidental destruction or deterioration of the purchased item. Items are acquired in the state and condition as they are at the moment of the successful bid. In all circumstances, the buyer has the obligation to purchase and to pay. If there are several highest bids, the bid received earliest will have preference. The striking of the hammer marks the acceptance of the highest bid and is a purchase. ![]() HIWEPA AG has the right at its discretion to combine any lots, to separate lots, offer lots out of numbering order or to withdraw lots from the auction.ĥ. HIWEPA AG has the right not to accept bids, in particular, if a requested payment of deposit has not been received or has not been deposited.Ĥ. All bids, orally or written, are binding, can not be withdrawn and are binding offers for purchase, as long as they are not overbid. Bidders who are unknown to the auctioneer will be requested to show proof of their identity. A bidder will be deemed to be acting as principal and will have to accept personal liability, even if submitting the bids on behalf of a named third party. When making a bid orally, in writing, by email or online, the bidder accepts these Conditions of Auction. These will be calculated according to point 6.ģ. The prices of lots in the auction are excluded from commissions, fees and value-added tax (VAT). The auction is carried out voluntarily and publicly in the name of and for the account of a third party based on consignment contracts.
